KWeb - Sample Contract

The Agreement between _________________________ referred to as User and KissimmeeWeb, a
wireless internet service provider, referred to as Provider in this agreement. This agreement shall be for
internet access service billed on a month to month basis.

Internet Speed up to 1500 kbps download & upload; speeds & uninterrupted service are not
guaranteed.

Premises Access shall be granted to provider for access to facilities and to roof top allowing
installation and maintenance of wireless equipment. Provider shall be granted access to change out or
remove the equipment as deemed necessary by provider.
Residential Wireless Equipment remains the property of Provider at all times, however User must make
certain that the equipment (next page) is covered under their property insurance for fire, theft or damage.

Acceptable Use dictates that excessive throughput of data for the category of service selected will be
questioned. If there is excessive usage the access fee will be increased, or services such as KAZAA
shall be severely limited. SPAM shall not be sent from your connection. Provider may at its discretion
disconnect service if User abuses the network or attempts to initiate a “Denial of Service” attack.

Provider Liability shall be limited to providing internet service only and not any damages due to other
factors. User shall not hold Provider liable for damage to facilities. Provider will exercise reasonable
caution to protect User’s property. Provider is not liable for computers of data corruption or loss within a
user’s network.

Cancellation requires the User to return the wireless equipment in order to discontinue this service. The
contract cancellation date will be the date the equipment is received by Provider. Once the equipment is
received, the User will receive any deposits (as mentioned in the Equipment section) plus or minus any
prorated internet service fees.

Change of Ownership/Location may be handled by moving the wireless equipment to a new location
(if in the coverage area), or transferring the service to the new owner. There is no additional
cancellation provision. Moving fees will be assessed to the User as appropriate.

Pricing Agreement is valid for month to month internet service; Provider reserves the right to change
monthly service pricing at anytime.
